Can I refile a paternity case as a father?

I filed a paternity case in FL, Im from Ny and so is my ex and son. She left to go there w/out me knowing. I filed a determination of paternity there(which I should’ve done it in ny) can i file in NY since the case is over in FL and im the petitioner. The burden is on me to travel, I pay 60% of all expenses for the child, plus health insurance, ,y travel costs, while on only getting 10% of the time with him. And besides all our families are here..can anyone advise?
I did the paternity test in ny but the petition to determine paternity was done in ny. I filed the case in Fl, the test needs to be done before the court hears the case to assure that the child is yours.

    I would speak to a lawyer about this. It sounds like somewhere someone isn’t doing what they are supposed to. I’m confused on why you would have to travel to do a paternity test, when I did one, my ex was in Georgia and I was in Ohio, I filed in Ohio where my son was born and they sent his swab up to the correct office and paternity was established.

    Florida law and several others may not allow a parent to change status of parent after so much time. If you are not the child’s father then you can petition but no guarantee that you will be removed. Father and mothers obligation does not change no matter where the child is. You can go to and file in the state the child and mother live in.
